JaccsLoan Terms and Conditions

Part 1: General Provisions

1.1 About This Document

Welcome to JaccsLoan! These Terms and Conditions (hereinafter referred to as the "Terms") constitute a legally binding agreement between you and VANTABLACK TECHNOLOGY CO. LTD. (hereinafter referred to as the "Company," "we," or the "Platform"), and apply to all your activities in accessing and using the JaccsLoan mobile application and related services.

1.2 Your Acknowledgment and Acceptance

By downloading, installing, or using the App, you acknowledge and confirm that:

  • You are at least 18 years of age and have full legal capacity to enter into contracts
  • You are a resident of the Philippines and hold a valid Philippine government-issued identification document
  • You have fully read and understood all the provisions of these Terms and agree to be bound by them
  • You agree to comply with all applicable Philippine laws, including but not limited to the Consumer Act and relevant financial regulations.

If you do not agree to any part of these Terms, please do not continue to use the App.

1.3 Our Business Model

Our Role

VANTABLACK TECHNOLOGY CO. LTD. is a pure technology service platform. We are responsible for the development, day-to-day operations, technical support, and customer service of the App, but we do not ourselves provide loan funds.

Partner Institution

All loan products displayed on this Platform are provided by financing or lending companies that hold a valid Certificate of Authority from the Philippine Securities and Exchange Commission (SEC). Under the Lending Company Regulation Act (Republic Act No. 9474), such institutions must obtain SEC authorization before they may engage in lending business.

The current partner institution information is as follows:

Partner Company Address: 38th Floor, Robinsons Equitable Tower, ADB Avenue corner Poveda Street, Ortigas Center, 1605, Pasig City

The partner institution is independently responsible for:

  • Loan product design and rate setting
  • Credit assessment and approval decisions
  • Fund disbursement and account management
  • Repayment processing and collection activities
  • Compliance with relevant regulatory requirements of the SEC and the Bangko Sentral ng Pilipinas (BSP).

Boundary of Responsibility: The Platform does not participate in credit decisions nor assume legal liability for the partner institution's loan performance.

Part 2: Account Management

2.1 Account Registration

To use our services, you need to:

  • Download the JaccsLoan app from official app stores
  • Register an account using your personally registered mobile number
  • Complete and provide accurate personal information as guided.

2.2 Account Security

You are responsible for all activities conducted under your account, including but not limited to:

  • Safeguarding your mobile number and one-time verification codes (OTPs)
  • Notifying us immediately through customer support channels upon detecting any unusual account activity
  • Logging out promptly after using public or shared devices.

We shall not be liable for any losses arising from your failure to properly safeguard your login credentials.

2.3 Truthfulness of Information

All information you provide must be truthful, accurate, and complete. If we find that the information is false, outdated, or involves fraud, we reserve the right to suspend or close your account and report the matter to the relevant authorities.

Part 3: Services and Loan Products

3.1 What We Offer

JaccsLoan provides you with the following digital services:

  • Information display and comparison of loan products
  • Online loan application and document upload
  • Real-time tracking of application progress
  • Repayment schedule inquiry and online repayment
  • In-app customer support.

3.2 Loan Product Parameters

Loan products available through this Platform have the following main parameters:

Minimum Loan Amount: ₱1,000

Maximum Loan Amount: ₱100,000

Minimum Repayment Term: 3 months

Maximum Repayment Term: 12 months

Annual Interest Rate Range: 18% – 28%

Please note: The actual approved amount, term, and interest rate will be determined based on the partner institution's credit assessment, taking into account factors such as your credit history, income level, employment stability, and existing liabilities.

3.3 Fee Description

Loans may involve the following fees (as specified in the loan agreement):

  • Service Fees: Covering application processing, credit investigation, risk review, and technical services
  • Government Taxes: Applicable taxes under Philippine tax laws
  • Late Fees: Penalties for failure to repay on time.

All fees will be itemized and displayed in the app before you confirm the loan. We never charge any fees that are not disclosed in advance.

3.4 Service Availability

We strive to maintain the continuity and stability of the Service, but do not guarantee absolute availability. In the event of service interruptions due to system maintenance, technical upgrades, or other uncontrollable factors, we will provide advance notice within a reasonable scope.

Part 4: Loan Application Process

4.1 Application Steps

The loan application process is as follows:

  • Download the JaccsLoan app and complete account registration
  • Fill in basic personal information, employment details, and financial status
  • Upload a valid government-issued ID and relevant supporting documents
  • Submit the loan application and authorize the credit assessment
  • The partner institution conducts the review (may contact you for additional materials)
  • Notification of approval result via in-app notification and SMS
  • If approved, confirm and sign the loan agreement online
  • Funds are disbursed to your designated bank account or e-wallet.

4.2 Approval Time

Fast Approval: Eligible applications may be completed in as little as 1 to 5 minutes;

Standard Approval: Most applications are reviewed within 24 hours;

Fund Disbursement: Typically credited within 24 to 48 hours after approval.

Actual timing may vary depending on the completeness of application documents, verification procedures, and bank processing speeds.

4.3 Application Status Inquiry

You can check your application progress at any time through the app. If additional materials are required, we will notify you via in-app notification or SMS.

Part 5: Repayment

5.1 Your Repayment Obligation

Repaying on time and in full is your legal responsibility. Please ensure that you proactively make repayments in accordance with the due dates and amounts stipulated in the loan agreement, through the methods designated in the app.

5.2 Repayment Schedule

The specific repayment schedule (including principal and interest due for each installment) will be displayed in the app after loan approval and will be available for you to download and save.

5.3 Consequences of Default

Failure to repay on time may result in the following consequences:

  • Incurring late payment fees or delinquency charges
  • Negative impact on your credit score
  • Delinquency information being reported to the Credit Information Corporation (CIC)
  • The partner institution pursuing collection measures in accordance with law, with all collection activities complying with SEC regulations on fair collection practices
  • In serious and prolonged default cases, potential legal action.

5.4 Early Repayment

You have the right to initiate early repayment at any time through the app, without any prepayment penalties or additional charges.

Part 6: Data Privacy and Protection

6.1 Privacy Policy

Our handling of your personal information is governed by the separate JaccsLoan Privacy Policy, which is formulated in accordance with the Philippine Data Privacy Act (Republic Act No. 10173). Please read it carefully before using the Service.

6.2 Information Sharing

You understand and agree that, to complete the loan service, your necessary information will be shared, within the authorized scope, with the following parties:

  • The partner institution, for credit assessment and post-loan management
  • The Credit Information Corporation (CIC), for credit record reporting
  • Authorized service providers, strictly for data processing purposes.

6.3 Your Data Rights

Under the Data Privacy Act, you have statutory rights over your personal data, including the right to be informed, right to access, right to rectification, right to erasure, and right to file a complaint. For details on how to exercise these rights, please refer to the relevant sections of the Privacy Policy.

Part 7: User Code of Conduct

7.1 Your Responsibilities

As a user of JaccsLoan, you agree to:

  • Provide and maintain true and accurate personal information
  • Repay all loan principal, interest, and related fees on time
  • Use the Service only for lawful purposes
  • Protect your account security and not share login credentials with others.

7.2 Prohibited Conduct

You shall not use the Platform to engage in the following:

  • Providing false information or impersonating another person
  • Engaging in any form of fraudulent activity
  • Attempting to bypass or disrupt the Platform's security mechanisms
  • Using the Service for illegal transactions or funding purposes
  • Interfering with other users' normal use of the Service
  • Unauthorized access to others' accounts or data.

Part 8: Intellectual Property

The JaccsLoan app, website, logos, interface designs, content, and all related intellectual property rights are owned by VANTABLACK TECHNOLOGY CO. LTD. or its licensors. You are granted only a limited, personal, non-exclusive, non-transferable license to use the App in the manner prescribed by these Terms.

Without our prior written consent, you may not copy, modify, distribute, decompile, or create derivative works based on the App.

Part 9: Limitation of Liability and Disclaimer

9.1 Service Status

The App and the Service are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the extent permitted by applicable law, the Company and its affiliates shall not be liable for:

  • Indirect, incidental, special, or punitive damages
  • Loss of profits, data loss, or goodwill damage
  • Any damages arising from the use or inability to use the Service
  • Unauthorized third-party access to your account or data.

9.3 Force Majeure

We shall not be liable for any service interruption or delay caused by events beyond our reasonable control, including but not limited to natural disasters, government actions, cyberattacks, power outages, or telecommunications failures.

Part 10: Indemnification

In the event of any claim, lawsuit, or demand arising from your breach of these Terms, improper use of the Service, or infringement of third-party legal rights, you agree to indemnify and hold harmless the Company and its affiliates, directors, and employees from all losses and expenses (including reasonable attorneys' fees) arising therefrom.

Part 11: Termination

11.1 Right to Terminate

We reserve the right to terminate or suspend your account access at any time, with or without prior notice, under the following circumstances:

  • You violate any provision of these Terms
  • We suspect fraud or illegal activity
  • Required by law or regulatory authorities
  • Your account has been inactive for an extended period.

11.2 Post-Termination Obligations

Upon termination, your right to access the Service will cease immediately. However, termination does not affect your obligation to repay any loans already obtained, nor does it affect our right to retain relevant records in accordance with law.

Part 12: Dispute Resolution

12.1 Amicable Negotiation

Any dispute arising out of these Terms shall first be resolved through amicable negotiation. The parties shall make every effort to reach a settlement within 30 days.

12.2 Arbitration

If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration, with a final and binding decision rendered by a sole arbitrator appointed in accordance with applicable law:

12.3 Judicial Jurisdiction

Matters involving intellectual property, injunctive relief, or specific issues explicitly provided by law may be subject to the exclusive jurisdiction of the competent courts of the Philippines.

Part 13: General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and the Loan Product Disclosure Documents, constitute the entire agreement between you and us, superseding all prior oral or written communications.

Severability: If any part of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that right or of any other right.

Assignment: You may not assign any rights or obligations under these Terms without our prior written consent. We may assign all or part of our rights without your consent.

Notices: We will send important notices to you via in-app notifications, SMS, or email. Please ensure your contact information remains up to date.

Language: The English version of these Terms shall prevail. In the event of any conflict between a translated version and the English version, the English version shall control.

Part 14: Amendments and Revisions

We reserve the right to revise these Terms at any time. For material changes affecting user rights, scope of liability, or service content, we will notify you via in-app pop-ups or prominent announcements before the changes take effect.

The revised Terms will become effective on the effective date indicated. If you continue to use the Service, you will be deemed to have accepted the revisions. If you do not agree, please immediately stop using the App.
